>> palo alto at 30, half moon bay at 32. and the san francisco zoo at 35 degrees. so yes, it was frigid this morning, but it is going to get even colder as we head throughout tomorrow morning. freeze warning now extended for the eastbound and also for the southbound at in this point. all areas pretty much except for san francisco will experience temperatures 25 to about 36 degrees. right now, the mercury is already dropping, so to speak. 44 right now here across san jose. you can see the south bay continues to cool off at this hour with temperatures that are even getting close to the 30s back here towards camel. los gatos at 38 and saratoga at 36.

>> we are here at the action day primary plus fifth annual tree lighting. these folks here are bundled up. they have the right idea. it's cold out here. you mentioned it's going to get even colder to night. i was looking at some of the long range models. basically i want to compare how last year will stack up to what we're headed for in the coming months. be you'll take a look at the graphic. in san jose we were pretty much average, daytime highs near 60 degrees. even our overnight lows you'll notice on the graph, january and february did dip into the lower than average category. now as we advance to this upcoming winter and the next couple of months, what we're going to find is looking at the rong-range models, it does seem as though our winter in san jose is going to remain average. we'll see daytime highs in the 60s, morning lows bottoming out

in the 40s. when you talk about averages, you have to keep in mind every single event. and of course, this is one single event that we're experiencing right now. so in the coming months we'll be tracking that as we move forward. but again, you can't just base one particular event off of an average. but the thing we're going to be tracking as we move forward is if we are going to see 20s and 30s become the new norm here across the bay area. and one thing, we actually did bottom out in the 20s last winter. one-time in san jose, it was january. and it was only one time. sop that's promising news as we move forward. jeff over to you. >> some great insight there. coming up we're going to detail some of the worst chill across the bay area. who would hit 21 degrees by 6:00 a.m. on your thursday. >> for many of us, we can simply turn up the heat in our house or grab an extra blanket. but for the thousands of homeless people in the bay area, there's no escaping the freezing

temperatures. for the homeless and the farmers, this is a critical night. damian trujillo joins us with more. >> reporter: they've been hundred dollarled up all day here along the parks. some say they'res used to these cold temperatures. they're going to get a good dose of that tonight. >> richard washington spent the day looking for the spot with the most sunshine at st. james park. >> it's right on you. 8:00, maybe about 3:00. >> there are roughly 5,000 to 7,000 people living on the streets in santa clara county. and there's only 300 emergency beds available at armories and shelters. >> my parents kicked me out a long time ago. i've been here ever since on probation. you know, i'm just trying to get my life together, you know? >> it will be another cold night for anthony coleman. one man who doesn't mind the

cold weather is the owner of andy's orchards. 60 ache oefrs apricots, cherries and peaches in morgan hill. the cold temps allow his trees to rest for the winter. >> it induces sleep. it causes the leaves to fall quicker and for the tree to go into a dormant state. and that kind of gives it a good sleep. >> and cold weather means more work for this man of becks heating and air conditioning. >> how busy are you? >> we're swamped. you have some people with no heat. you imagine everyone gets cold at the same time. >> and they are cold at st. james park, another night of shivering for the people who have little choice but to sleep on these benches. and at this hour, the homeless keep coming and going at st. james park.

of today's big b.a.r.t. problem. a frightening experience for hundreds of riders when dust and smoke filled the trades they were riding in. this video captures some of the chaos during the morning commute. the train suddenly stopped in the berkeley hills tunnel. nbc bay area cheryl herd join uses from the rockridge station this evening with new information about what went wrong. cheryl? >> that's right, rog. we are learning tonight that the problem was electrical. but even though we know that, engineers are still trying to sort things out. the trains are back on time. but because of what happened earlier today, some passengers are still on edge. >> it was the toughest thing for some b.a.r.t. riders this morning. >> a train traveling 70 miles an hour per hour suddenly stop when b.a.r.t. officials say the parking brake engaged. nine people were sent to the

hospital. >> they would not open the door and people started get getting sick. they said why can't they open the door if people cannot breathe. i kept thinking why wouldn't they open the door. >> you can see some of the confusion on the train. you could also see passengers helping one another when some riders became overcome by the smell. >> it turned out we came back. so i don't know, the information was all reversed. >> so there's two staging areas. we september rescue trains into the tunnel to help passengers. some requireds were stuck in the tunnel for over an hour before the disabled train was able to get to the station on its'> o power. >> it was very scary experience. because when we were trapped there, we started snelling the electrical smoke.

and what happened was that we weren't being communicated. the b.a.r.t. system now wasn't communica communicating. . >> there's been a lot of mechanical problems on b.a.r.t. lately. whether it's strike related or something else, whether it's police activity. it's very frustrating tor a b.a.r.t. rider right now. >> b.a.r.t. officials tell me tonight that the trains are old, 40-plus years old. they say they're working to bring new trains online. but those trains can't come online soon enough. >> reporting live in oakland, i'm cheryl herd, nbc bay area news. >> tonight, we're learning more about the victim in the latest traffic dlet deaths in san jose. police say it was a 17-year-old cyclist named anthony garcia, killed last night. investigators say a driver hit him near the corner of vista park drive and branham lane just before 7:00 in the evening. the teen was rushed to the hospital. but died soon after. the driver is said to be cooperating with investigators. the accident, though, brings the number of deadly automobiles

versus pedestrian and cycling crashes in 2013 to 25. that's nearly twice the number of 2012. >> we have video of people who live in an apartment complex after they were evacuated earlier today. after code enforcement team was inspecting the building when they found a pipe bomb in the complex's utility closet. police summoned the walnut creek bomb squad to disable the device. investigators say they have no leads and no motives. >> plus still ahead here at 6:00, a christmas time predator. san francisco leaders are describing a suspect who allegedly gunned down a man over a play station. the clues that led police to their man. plus -- >> whether h worked for san jose as a janitor or a cop, we all deserve to have our pay restored. >> police officers are getting pay raises in san jose, but what about the other unions. some city workers are grumble popping i'm jody hernandez in

a fire in san jose broke out around 2:00 in the morning near mon that ray and blossom hill road. firefighters searched the unit. they didn't find anybody inside. police tell us the man who lives there wasn't home and still hasn't been reached. >> san mateo police are looking

for a suspect in a violent robbery. it happened last week in the central park area of san mateo. one on tuesday, one or thursday. both times a man approached a woman, hit her, stole her purse and ran. investigators say he's dark skinned about 25 years old and was last seen wearing a dark puffy jacket and a black hat. >> fallout tonight from the pay raise the police officers are getting, a 10% cut they took two years ago. other city workers are asking, what about us? >> a lott of the sdi workers are asking that question, but they don't begrudge the fact that the police are about to get $6.5 million in extra pay over the next three fiscal years. if the city can find money for police, perhaps it's time for the city to dig deep and find money for the other employees who also took pay cuts. >> i certainly hope that our union will negotiate the p.o.a.

for their employees. >> san jose police dispatchers are among the city workers who are watching the san jose police association negotiations with the city very carefully. tuesday, the union ratified a 10% pay raise ov2 1/2 years. dispatchers took the same 10% pay cut during the recession, but in their latest contract only got 2% back from the city. >> we had to pay more into our retirement and more into our medical. so it was a 0.27% increase in our paycheck. which on an average $60 a year is $6.23 a paycheck before tacks. >> still, dispatchers are hopeful if the police got more money back, they will, too. but the mayor said yesterday the offer won't be on the table for all city worker ps. >> we don't have the money to give everybody the same deal. but obviously we have issues we're dealing with in the police department.

>> san jose firefighters have been working without a contract for five months as they await a legal ruling on the mayor's pension reform. but the union president says the deal between the police and the city is setting the bar for other negotiations. >> while the city was negotiating this 10% increase for police officers, they were offering our members 2%, right? so certainly our members see the distinct difference between 10 and 2. >> the labor council agrees. >> they've proven with the police they can move when they want to and they can move in a way that both sides win. >> now, you can read the police deal on the city's website including the additional cost of the city expected it would incur if the court does not uphold the savings from that pension reform measure. a city council will discuss this and likely vote yes for that police deal in open session next tuesday. in san jose, chris sanchez, nbc bay area news. >> getting back to our top story, freezing weather, cold

and snow. take a look in the sierra. skiers and snowboarders are smiling ear to ear. plenty of fresh powder when you head up the mountain. live from the boreal mountain resort. this is already popular for night skiing. it looks gorgeous behind you. >> and that night skiing is well under way. i tell you, people are having a ball out here. they are shredding, cutting, pumping the track. you would not believe the fun folks are having out here. we got a big lesson today from snow lovers who shared their excitement over all the to fresh snow. >> people are ready for winter. they're ready to go skiing and snowboarding. we're happy to have them. >> it's all smiles on the slopes as skiers and snowboarders take advantage of newly delivered fouder or pow as they call it. pow brought in by the biggest snorm system so far. >> two lifts over. but up top, there's a nice

little punk track, i would say four to five inches of fresh pow this morning. maybe more on the edge of, like, six or seven. in some good spots. but real wind blown. >> cal berkeley student traded in his book for snow boots today. waking up at the crack of dawn to enjoy a day on the mountain. >> got a little bit of fresh snow. there was some white action this morning up tom. just tons of pow, super fun. some awesome park. it was a great day. >> he's not the only one who played hookie. diana ferris had to hit the slopes with her sister. >> the first storm came on tuesday. what was that? last night? big storm came last night. i knew i was calling in sick today. >> as thrilled as snow lover are, they are even more pumped knowing more snow is on the way. >> oh, it's nice. i'm cutting the rails. it's nice. shredding the nar.

there. a lot of that is happening from the snow making machines they have going across lake tahoe. i want to take you to our biggest concern. the freeze warning from north bay all the way down to the southbound, the temperatures will be dropping from the 25 to the 36. >>. >> you'll likely stay in the upper 40s. let's get you into our 246-hour forecast. you'll see for the south bay, low 30s to start. 49 degrees by the noon miles an hour. we'll see that replicated in the peninsula. not quite as cold a start. some of the ocean air that filters in helps to insulate you just a little bit. but again, very close to that freezing mark. record-setting lows possible in san francisco. 37 and sunny, 50 degrees as we

head throughout the afternoon. makes this 23 feel like the teens. by lunchtime, 49. and also for the trivalley, you're starting with temperatures in the upper 20s. now i do want toed a vas things and take a look at friday's forecast. that's the next largest change here in the weather story. not only will temperatures stay on the cool side. a chance of shower ace cross the bay area, but up across lake tah tahoe, we are looking at potentially a foot and maybe even a little bit more here across this sierra, some of the early estimates could have 16 to about 17 inches heef across the tahoe region. >> with that storm, a lot of cold air aloft. how about some snow close to the bay area. there's santa rosa. there's the rain/snow line as we head throughout friday morning at this point. we're going to continue to track some low snow as we head through friday's forecast. >> imagine taking a christmas tree with your smart phone and

the man accused of killing another over a play sdags on sunday appeared in court for the first time today.

he faces charges that could put him in prison for 75 years. nbc bay area's joe rosado jr. show us what prosecutors say they think ed will to the kill. >> the suspect faced his alleged killer for the first time. ronnie collins didn't enter a plea during a brief hearing in which he was described as a christmas time predator. >> if you think about what occurred there. it's the very antithesis of the season of giving. >> clark described how collins answered an ad for a play station 4 that his girlfriend and he most posted on insta gra. . they agreed to meet on bay view. >> they tried to get the young lady to walk from the walgreens by herself to the park. she declined. >> collins walked up to the car and pulled the gun on him. he offered to give him the play

station. >> he indicated that here, have the play station, here have the play station, this isn't worth it. >> the suspect replied "nah" and fired four shots. the public defender mark jacobs objected to the description of collins as a predator. >> we don't need name calls and people being demonized before they have a chance to sit in front of a jury. >> prosecutors say they traced collins through hinstagram account. >> does governor christie want to become president christie? the new jersey governor is gain traction here in california, which is always a key support base. a new pole shows christie is viewed most favorably among the

pack of leading republicans who might lead republican presidential candidates in 2016. caliifornians perceive the tea party as a drag on the g.o.p. and they like christie for not embracing the movement. the other republicans named in the pole were moved as more unfavorable than favorable. they include jeb bush in florida. senator ted cruz of the texas and senator ran dp paul of kentucky. >> coming up, is this a kidnapping? the video police want you to see and what we could hear from the woman heard on the tape. also -- >> i'm kimberly terry life in san jose where we have new video of a search for a local man and his family in the idaho wilderness. search and rescue teams decided to bring in more support today. >> also, we have new details in the actor paul walker's death. we have a new report next.

still no sign in the search far silicon valley executive and his family has been called off for the night. his plane went down. dale smith parks his plane. kimberly, i understand we have new video of the search up

north. we'll have the video in a couple of seconds. today's search wrapped up a couple of hours ago. still no search of survivors. but this search is set to resume bright and early tomorrow morning. >> it's been three days since dale smith and his family have been heard from. he was celebrating thanksgiving with his family. his wife posted this photo on her facebook account. about 125 miles northeast of boise, there was engine trouble. >> central idaho is very rugged as far as terrain goes. there's a lot of very steep mountains, many of the peaks go up to 8,000 or 9,000 feet in that area. >> today, the search and rescue party grew to 60 people and more aircraft were added to try to locate the missing plane. its emergency beacon has sent

out a signal. >> it was a very faint signal that was picked up yesterday. >> but emergency officials say it isn't reliable. the mountainous terrain makes the signal difficult to point and the transmitter hasn't pinged again. >> it could have been from a variety of different areas all up along that canyon. >> the search area was expanded today. but the major concern is the freezing temperatures. >> it got below 0 in that area last night. >> emergency officials say even if the family sur rooifed the crash, they have to contend with the elements. loved ones say dale and his son daniel were on the plane. also onboard, dale's 21-year-old daughter amber and her fi yn se, shown here on facebookfaib. they planned to get married january 4. >> we're told smith and his wife have five children together in all. his wife is said to be near the search and rescue operations in central idaho. of course, desperately awaiting any word on her loved ones. live in san jose, kimberly terry, nbc, bay area news.

>> very difficult time. thank you, kimberly. so is it a kidnapping in progress? that's what cops want to know after a violent scuffle is caught on camera. and then the attacker and the victim are nowhere to be found. >> no! >> bus recorded the video last night at 6:00. police say the driver had just pulled up when she witnessed this. the driver saw the man dragging the woman into the bushes. but by the time police arrived, just within two minutes they could no longer find the couple. >> we have not seen from them or heard from them since. we're not sure exactly what occurred. we're releasing this video here today and hopefully the participants in the video will come forward and let us know what happened or if anybody else can identify them and again

provide us a lead to follow up on. >> tonight, they don't believe the public is in dang ebut they do want to know what happened to that woman. >> a first step, get the health care website back up and running. so what's next for the president. >> tonight's reality check takes a closer look at the president's pitch today in d.c. sam brock joins us. >> good evening. the president went to one of the poorest most underserved communities in the entire country today to make a point that wealth and income and equality in the u.s. just continues to get worse. and he's right. but that didn't stop the president from beefing up his case with some questionable claims. >> still stinging from problems with the health care website, the president sought to convince americans that federal programs are needed to close the growing divide between the haves and the have notes. one example, helping service employees make a high enough wage to live above the povr tiff line. >> that's why it's well past the sometime to raise the minimum

wage which was below where it was when harry truman was in office. >> the truth is, the president is right. the minimum wage is lowner real dollars than it was in 1950. but it's also lower now in real dollars than it was under lyndon b. johnson when it peaked, nixon, ford, carter, george h.w. bush and president clinton. you don't need to go back six decades to find a real comparison. >> i think it's fallen in real terms, whether you reference it to truman or lbj. >> as for a plain old income disparity, the president sounded off on a widening gap. >> the top 10% no longer takes in 1/3 of our income, it now takes half. >> but is it really that skewed? '. >> it looks like the president is using a well regarded federal reserve study. the top 5% and 9% added up to

almost 90% of all incomes. but the congressional budget office came out with updated filg you'res today. in recent figures, the top 10% o after all earners accounted for 76%. compare that to 1979 when the study started. and the top 10% brought in 29.9%, and you can see a trend developing here. most of the gains of the recovery have flown to the top. that's also been true over the last 30 years in which there's been a substantial increase in income and equality and an even greater increase in wealth and equality as most of the gains have gone to the top 1%. the point is, there's really no question. the wealth and income divide has widened. there's not been this sort of gap since the roaring 1920s. it did appear the president faj exaggerated some of his numbers and .statements to help make his case. but still he's right.

in 2013, we have an historically unequal society. that's today's "reality check." >> thank you, sam. mexican authorities say they have recovered radioactive material missing since monday. now, that material was being trucked from a hospital in tijuana to a radioactive waste storage city when the vehicle was stolen from a gas station. after a widespread hunt, the truck was found not far from the gas station. these pictures are of the container carrying cobattle 60. but it can also be used to make a radioactive dirty bomb. they believe thieves opened the conta container, were burned and are either dead or dieing. officials have closed the area to safely clean up that material. >> "fast and furious" star paul walker died within seconds of saturday's crash according to the coroner in southern california. the cause of the death was traumatic injuries and burns.

>> last night, city council voted unanimously to include electronic cigarettes in its tough anti-smoking laws. state leaders say not only is there a lack of research on the new devices but they worry they could access real cigarettes, especially for kids. it allows kids to breathe nicotine vapor and are not yet regulated by the fda. the bill will get a second reading in january and could become law as soon as 90 days after. >> it's a sign of the times. cybermonday beats black friday to a pulp. in fact, online shoppers on monday set a new spending record. the sales were reported by the dinlal data firm. almost a 20% improvement last year and was the heaviest

>> danger will running back bin son. looking for chubacca and ha hans solo here. >> dropping chillier than what we had. alamo, pleasantton. san francisco zoo getting to 35. overall today, some of the chilliest weather is in napa. we are certainly going to rival all of that as we head to tomorrow morning. even a few spots colder. like the eastbound. and also for the southbound. they have now been added into the freeze warning. primarily as we head throughout tomorrow morning. temperatures ranging 25 to 36 degrees. the only spot that is not included in that is san francisco. you can see it's not shaded. also in this, of course, san jose all the way down to morgan hill and also gilroy where temperatures could range between 25 to 36 degrees.

we're averaging temperatures to the upper 30s and low 40s across the northbound. san francisco, the eastbound with 41. let's take you across the south bay. across the soub 7:00 a.m., 31 degrees. 3:00 p.m., just expecting 50. it will be sunny. more on that coming up."sw let's take you to the overall pattern. this is different than just plain old cool air coming across the bay. we pull down all of this cooler air from canada to alaska. for at least the next two days. chilly mornings with us. we're going to see numbers replicated for at least the next two mornings. 21 in santa rosa this morning. those are likely our coldest.
